The
newly elected HOA board has no authority to overturn any
decisions made by the previous board in relation to
the HOA covenants (See Sections 5.1.11 or 5.1.14 of the
HOA covenants). Therefore, any structure placed on a
property that did not meet HOA covenant regulations and was
already in place at the time the newly elected HOA
board took over cannot be addressed by the current HOA board
while the homeowner owns the property. HOWEVER, the board
reserves the right to address all previous violations if the
property goes on the market for sale. This will ensure that
violations will not be passed from homeowner to homeowner.
The original homeowner will be
responsible for either bringing their property into
compliance, or notifying the buyer of the property, before
sale, that the new homeowner will be required to bring the
property into compliance. In order to do this, any homeowner
who elects NOT to bring their property into compliance
before sale will have the violation noted on the lien letter
requested by title companies. By doing this, the board
ensures that all parties involved are aware of the
situation. Realtors may also be advised of the situation so
that they can properly market the property.
Proposals will need to be
sent to the HOA board in writing (see
Contact Us for instructions). In addition, the current board will be
enforcing covenant violations.
Please remember that it is the duty
of the HOA board to enforce the covenants on behalf of the
entire HOA. The board would like to do this
as amicably as possible. Therefore, before
listing any addresses on this web page, we will try
everything in our power to amicably solve the situation.
Only those homeowners who refuse to work with the HOA
board will be listed here. It is not the
intention of the board to embarrass or harass the
violating homeowners. Instead, the purpose for posting
the addresses of those homeowners who refuse to work
with the board to find a solution is to assure the rest
of the homeowners that the HOA board is aware of the
issue, and are working towards a resolution.
In the above situation where a homeowner refuses to work with the HOA board, the
board will take all legal and equitable remedies
available in addition to posting the address
below.
